Government Resolves Tangerang Coastal Land Dispute With Voluntary Release of 210 Plots

JAKARTA, Investortrust.id — Minister of Agrarian Affairs and Spatial Planning and Head of the National Land Agency Nusron Wahid has announced that 210 plots of coastal land in Tangerang have been voluntarily released by their owners. The step marks significant progress in resolving a protracted land dispute that has drawn attention from the public and policymakers.
During a working session with Commission II of the House of Representatives in Jakarta on Monday, Sept. 8, 2025, Nusron explained that the released land covered a total of 303.47 hectares. “Through the voluntary release mechanism, 210 plots covering 303.47 hectares have been handed back,” he said in a Parliament TV broadcast monitored on Tuesday, Sept. 9, 2025.
Voluntary release in Indonesian land law refers to a process where landholders willingly surrender their rights back to the state. Unlike revocation or expropriation, which often involve government intervention, disputes, or compensation, voluntary release is initiated by the owners themselves through a formal declaration to the Ministry of Agrarian Affairs and Spatial Planning. Once recorded, the land certificates are voided, allowing the government to reassert control over the area without legal conflict.
In addition to voluntary releases, the government also canceled 50 land titles covering 74.77 hectares. The cancellations consisted of 38 building use rights (SHGB) certificates spanning 58.23 hectares and 12 ownership rights (SHM) certificates covering 16.52 hectares. “The settlement of the coastal land case also proceeded through cancellations of 50 plots covering 74.77 hectares,” Nusron added.

The Ministry of Agrarian Affairs and Spatial Planning previously recorded 263 SHGB plots over the coastal area. These comprised 234 plots under PT Intan Agung Makmur, 20 plots under PT Cahaya Inti Sentosa, and 9 plots under individual ownership. In addition, 17 plots were registered with SHM.
Agung Sedayu Group, through its subsidiaries PT Intan Agung Makmur and PT Cahaya Inti Sentosa, which is under one of Indonesia's largest property developer PT Pantai Indah Kapuk Dua Tbk control, held the majority of the plots located in Kohod Village, Pakuhaji District, Tangerang Regency, Banten.
The group’s legal representative, Muannas Alaidid, stressed that all SHGB certificates owned by his client were obtained in line with existing rules and mechanisms.
The resolution of this dispute represents the government’s effort to provide legal certainty over ownership of strategic coastal areas. Authorities expect the decision will accelerate spatial planning in the region and reduce the risk of future agrarian conflicts.
