DPR Approves Fourth Amendment Draft Bill on Mineral and Coal Mining
JAKARTA, investortrust.id – The Legislative Body of Indonesia’s House of Representatives has approved the draft bill for the Fourth Amendment to Law No. 4 of 2009 on Mineral and Coal Mining. This legislative initiative will now be presented at the upcoming plenary session, scheduled for Tuesday, Jan. 21, 2025.
During a lengthy session that began on Monday morning and extended late into the night, the draft bill received unanimous approval. Bob Hasan, chair of the legislative body, presided over the decision-making meeting held in Senayan, Jakarta. The session concluded with an agreement to advance the draft, followed by the signing of the document.
The amendment process has been swift, with the drafting session lasting just one day. Notably, most legislators received the academic text only shortly before the plenary meeting. Bob Hasan emphasized the need for further analysis and urged the inclusion of input from stakeholders such as mining experts, linguistic professionals, and industry representatives to refine the bill.
The Fourth Amendment addresses directives from the Constitutional Court, which previously ruled on the Minerba Law four times, granting two conditional rulings. These revisions align with binding legal requirements and introduce new substantive provisions.
Key updates include measures to accelerate downstream mineral and coal processing to support energy self-sufficiency. The bill also proposes granting mining business permits, known as IUPs, to religious organizations, higher education institutions, and Micro, Small, and Medium Enterprises (MSMEs).
In his closing remarks, Bob Hasan underscored the importance of public participation in refining the bill. He called for comprehensive collaboration with stakeholders to ensure the amendments address both legal mandates and broader industry concerns effectively.
